Drama unfolded at the High Court on Thursday, May 28, after Bunge La Mwananchi leader Evans Kawala Jasuba stunned lawyers, court officials and members of the public with responses that nearly appeared to admit guilt in a high-profile terrorism incitement case linked to President William Ruto.
Jasuba was arraigned over allegations that he incited Kenyans to commit a terrorist act against President Ruto during remarks made at Nairobi’s Jacaranda Grounds.
However, it was not just the charges that captured attention, but the accused man’s unexpected responses in court that left even seasoned advocates visibly shocked.
“These words were calculated to incite the Kenyan public to carry out a terrorist act against the Head of State. Evans Kawala, have you understood the charge? Is it true or not true?” the official asked.
Jasuba’s answer instantly triggered murmurs inside the courtroom.
“Yes, I understand, but that one is just content,” he responded, drawing restrained laughter from those present and visible concern from his legal team.
When pressed a second time to clearly state whether the accusations were true or not true, Jasuba reportedly began responding in a manner that alarmed his lawyers.
Embakasi East MP and advocate Babu Owino quickly intervened, sharply instructing him, “Don’t talk,” before further damage could be done to the defence.
Despite the tense exchange, the court eventually entered a plea of not guilty on his behalf and proceeded with the matter.
Babu Owino then passionately appealed for lenient bail terms, arguing that the accused remained innocent until proven guilty.
“Even if you look at his face, there is still innocence in him,” Babu told the court.
The judge granted Jasuba release on a KSh 500,000 bond with one surety of the same amount or an alternative cash bail of KSh 50,000.
Jasuba, who was arrested by Directorate of Criminal Investigations officers in Kayole, will return to court on June 22 as the explosive case continues to attract national attention.
