Utumishi Girls Fire Suspects Could Walk Free, Lawyer Danstan Omari Explains Why

Lawyer Danstan Omari has weighed in on the legal debate surrounding the tragic fire at Utumishi Girls Academy, warning that the eight students linked to the incident could eventually walk free if due process is not followed.

The fire, which broke out in the early hours of Thursday, May 28, at the Meline Waithera dormitory, left the country in shock after claiming the lives of 16 students and injuring 79 others. The incident sparked nationwide grief and renewed concerns about school safety.

According to investigators, the suspects were allegedly captured setting the dormitory ablaze while fellow students were asleep inside. 

The allegations have fueled public anger, with many Kenyans demanding swift punishment for those found responsible.

The eight students appeared in court on Tuesday, June 2, as prosecutors sought orders to detain them for 30 days to allow investigators to complete their inquiries into the deadly tragedy.

Speaking about the matter, Omari said many Kenyans were allowing emotions to overshadow constitutional and legal requirements. 

He noted that while the pain caused by the incident was understandable, suspects still have rights that must be protected under the law.

“People hate them. People want them jailed. People think they should not be arraigned and witnesses called. They should be summarily jailed. That is the annoyance. We understand the pain,” Omari said while discussing the public reaction to the case.

The lawyer emphasized that criminal cases cannot be determined through public opinion or social media pressure.

Instead, investigators and prosecutors must gather evidence capable of proving the allegations beyond reasonable doubt in court.

Omari explained that if investigators fail to follow proper procedures or present sufficient evidence, the suspects could be acquitted regardless of the public's expectations. He stressed that the Constitution guarantees every accused person the right to a fair trial.

His remarks have generated mixed reactions, with some Kenyans supporting his call for adherence to the law, while others argue that the scale of the tragedy demands immediate accountability for those involved.

Meanwhile, authorities continue with investigations to establish the exact circumstances surrounding the fire. Detectives are expected to analyze witness statements, forensic findings, and other evidence before deciding on the next course of action.
